U.S. District Judge Irene C. Berger said Trump administration officials lack the authority to unilaterally cancel the screening program for black lung.

The Centers for Disease Control and Prevention has reinstated nearly 200 workers who screen coal miners for black lung, an incurable progressive disease caused by long-term exposure to coal dust, following a federal judge’s order Tuesday.

Federal judge orders “full restoration” of NIOSH services relied on by coal miners to prevent further illness and injury.

Miners diagnosed with black lung are given the option to transfer to other positions to protect them from continued dust exposure.
